Terms & Conditions for LivePlant App

These Terms & Conditions (“Terms”) govern your access to and use of the LivePlant mobile application and related in-app services provided by LivePlant App.

By downloading, accessing, or using the LivePlant app, you agree to these Terms. If you do not agree, do not use the app.

1. Scope of These Terms

These Terms apply only to the LivePlant mobile app and the services available through the app.

These Terms do not govern any separate website unless that website specifically links to these Terms.

If you downloaded the app from the Apple App Store, Apple’s terms, App Store rules, and applicable device terms may also apply to your use of the app and in-app purchases.

2. Eligibility

You may use LivePlant only if:

  • you are legally capable of entering into a binding agreement; and
  • your use of the app is permitted under applicable law.

If you are under the age of majority in your jurisdiction, you may use LivePlant only with the involvement and permission of a parent or legal guardian.

3. Your Account

To access certain features, you may need to create an account.

You agree to:

  • provide accurate and current information;
  • keep your login credentials secure;
  • accept responsibility for activity that occurs under your account; and
  • notify us promptly if you believe your account has been accessed without authorization.

We may suspend or terminate access if we reasonably believe your account is being used unlawfully, fraudulently, abusively, or in violation of these Terms.

4. App Features

LivePlant may provide features including:

  • plant identification;
  • plant disease diagnosis;
  • plant care information;
  • plant reminders and push notifications;
  • plant gallery and progress tracking;
  • saved plant collections, notes, and care history;
  • weather-based and location-based care context, if enabled;
  • free and paid subscription-based access levels.

Features may change over time. We may add, remove, improve, limit, or discontinue features at our discretion.

5. Free and Paid Access

LivePlant may offer both free and paid access.

Free Access

Free users may have access to selected features, subject to usage limits, restrictions, or feature gating.

At the time of publication of these Terms, LivePlant may limit certain advanced features for free users, including premium diagnosis or premium usage limits.

Paid Access

Paid users may receive access to premium features through an eligible subscription or one-time purchase.

Paid access may include, for example:

  • unlimited plant identification;
  • plant disease diagnosis;
  • premium or expanded plant insights;
  • other premium features we may offer from time to time.

6. Subscriptions and Purchases

LivePlant may offer the following purchase types through Apple’s in-app purchase system:

  • Monthly subscription;
  • Yearly subscription;
  • Lifetime access as a one-time purchase, if offered.

Auto-Renewable Subscriptions

Monthly and yearly plans are auto-renewable subscriptions.

This means:

  • payment is charged to your Apple account at confirmation of purchase;
  • subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period or trial period;
  • your account will be charged for renewal within the 24-hour period before the end of the current period;
  • you can manage or cancel subscriptions in your Apple account settings after purchase.

Free Trial

If offered and if you are eligible, a subscription may include a 7-day free trial.

If you do not cancel before the free trial ends, your selected subscription will automatically convert to a paid subscription and you will be charged through Apple.

Free trial eligibility is determined by Apple and may not be available to all users.

Lifetime Access

If offered, lifetime access is a one-time non-consumable purchase, not a recurring subscription. Once purchased, it does not auto-renew.

Restore Purchases

If you previously purchased eligible premium access, you may restore purchases using the restore feature in the app.

Billing and Refunds

All billing, renewals, cancellations, and refunds for iOS in-app purchases are handled by Apple under Apple’s terms and policies. We do not control Apple’s billing systems or refund decisions.

7. Pricing and Availability

Prices, plans, free-trial offers, and feature availability may vary by country, currency, platform, or promotional period.

We may change pricing or product availability in the future, but changes will not retroactively affect a purchase already confirmed by Apple for the current billing period.

8. User Content

You may upload or submit content through the app, including:

  • plant photos;
  • gallery photos;
  • notes;
  • saved plant information;
  • reminder settings;
  • plant care history.

You retain ownership of the content you submit, but you grant us a limited, non-exclusive, worldwide license to host, store, process, reproduce, and use that content only as necessary to operate, improve, secure, and support the LivePlant app and its features.

You represent and warrant that:

  • you own the content you upload or have the necessary rights to use it;
  • your content does not violate any law or infringe any third-party rights; and
  • your content does not contain unlawful, abusive, harmful, or fraudulent material.

9. Acceptable Use

You agree not to:

  • use the app for unlawful, fraudulent, deceptive, or harmful purposes;
  • misuse or interfere with the app, its systems, or other users;
  • attempt to reverse engineer, probe, or bypass app security;
  • upload malicious code, scripts, or harmful content;
  • use bots, automation, or scraping in a way that harms the service;
  • resell, sublicense, or commercially exploit the app except as expressly permitted by us;
  • abuse free trials, free quotas, or purchase restoration features.

10. AI, Plant Advice, and Informational Disclaimer

LivePlant provides AI-assisted plant identification, plant disease diagnosis, and care-related suggestions for informational purposes only.

You understand and agree that:

  • results may not always be accurate, complete, or suitable for your specific plant or environment;
  • plant identification and disease diagnosis are automated or AI-assisted outputs and may be incorrect;
  • plant care recommendations are general informational guidance only;
  • LivePlant is not a substitute for professional horticultural, agricultural, pest-management, botanical, or nursery advice.

You are solely responsible for any decisions or actions you take based on app content, including treatment decisions, fertilizer use, pruning, pesticide use, watering, or moving plants.

11. Location and Notifications

If you allow location access, the app may use your location to provide weather-based or region-specific plant care information.

If you enable push notifications, the app may send plant reminder notifications and related updates.

Location and push notifications are optional, and you can disable them in your device settings.

12. Third-Party Services

The LivePlant app relies on third-party services to provide some functionality. These may include, for example:

  • Apple for in-app purchases and Sign in with Apple;
  • Google for sign-in services, where used;
  • Supabase for authentication, storage, and backend functionality;
  • RevenueCat for subscription and entitlement management;
  • OneSignal for push notifications;
  • OpenRouter and underlying AI model providers for plant identification and diagnosis;
  • WeatherAPI for weather-related services.

We are not responsible for third-party services, products, or policies that we do not control.

13. Intellectual Property

The LivePlant app, including its software, branding, designs, text, graphics, icons, features, and related content, is owned by or licensed to LivePlant App and is protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, display, sell, lease, reverse engineer, or exploit any part of the app or its content.

14. Termination and Suspension

We may suspend, restrict, or terminate your access to LivePlant if:

  • you violate these Terms;
  • we suspect fraud, abuse, or unauthorized use;
  • required by law;
  • necessary to protect the app, our users, or our rights.

You may stop using the app at any time. Deleting the app or deleting your account does not automatically cancel an active subscription. Subscriptions must be canceled through Apple’s subscription management tools.

15. No Warranty

To the fullest extent permitted by law, LivePlant is provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

We do not guarantee that:

  • the app will be uninterrupted, secure, or error-free;
  • plant identifications or diagnoses will be accurate;
  • reminders will always be delivered on time or at all;
  • the app will always be available in every region or on every device.

16. Limitation of Liability

To the fullest extent permitted by law, LivePlant App, its affiliates, licensors, service providers, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, plants, crops, property, or business opportunity arising out of or related to your use of LivePlant.

To the fullest extent permitted by law, our total liability for any claim relating to the app will not exceed the amount you paid to us through the app, if any, during the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

17. Indemnification

You agree to defend, indemnify, and hold harmless LivePlant App, its affiliates, contractors, service providers, and partners from and against claims, liabilities, damages, losses, and expenses arising out of:

  • your use of the app;
  • your content;
  • your violation of these Terms; or
  • your violation of any law or third-party rights.

18. Changes to the App or These Terms

We may modify the app, its features, plans, pricing, or these Terms from time to time.

If we update these Terms, we may revise the “Last Updated” date above. Your continued use of LivePlant after the updated Terms become effective means you accept the revised Terms.

19. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law rules, except where applicable law requires otherwise.

Any disputes arising from these Terms or your use of the app will be subject to the courts located in India, unless applicable law provides otherwise.
